Going through a divorce can be stressful and upsetting. The breakdown of a marriage can leave both parties feeling distressed and worried about the future. Divorce can not only be difficult emotionally, but it can also become technical and complex at times.

There is only one ground for divorce and that is irretrievable breakdown of the marriage. The party who is applying for the divorce (Petitioner) must rely on one of five facts to prove irretrievable breakdown:

  • Adultery
  • Unreasonable behaviour
  • Desertion
  • Separation for a period of 2 years (if other party consents)
  • Separation for 5 years (no consent needed)
